The Hon’ble Mr. Arun Mishra, Chief Justice and His companion justices of the said Hon’ble Court. The humble petition of the petitioner above named most respectfully – S H E W E T H: 1. That your petitioner is the citizen of India and permanently resides at the address given in the cause title. 2. That your petition has falsely implicated in Shantinagar Police Station Case No. XXX dated dd.mm.yy under Sections 498A/406 of the Indian Penal Code taking cognizance with Final Charge Sheet No. XXX, dated dd.mm.yy under Sections 498A/406. Now this is pending before the court of the learned Judicial Magistrate Xth Court Shivpore, XXX. 3. Police was politically biased and falsely incurred your petitioner by the false complaint of de facto complainant/wife of your petitioner. The investigation of the said case is ended with Final Charge Sheet No. XXX, dated dd.mm.yy. 4. Your petitioner wanted to know the investigation process and documentary evidences of prima facie to charge on the above sections by RTI Act 2005 but above said public authorities did not give proper answers which is against your petitioner’s fundamental rights. 5. That your petitioner has filed his Fresh Application under RTI Act 2005 on 17th march 2013 (Annexure A). The Fresh Application was forwarded by SPIO of Law Department to another SPIO of Shantinagar PS u/s 6(3) of RTI Act 2005 on 29th March, 2013(Annexure B). 6. That the same Fresh Application was forwarded by SPIO of Law Department to another SPIO of Supdt. of Police, Alipore (Annexure C). 7. That your petitioner was aggrieved by the reply of the DSP (Industrial). The letter dated 24th April, 2013 stated that the DSP (Industrial) could neither answer any question nor could supply any document as your petitioner’s case is a sub-judice case(Annexure D). That your petitioner again filed First Appeal under RTI Act 2005 on 16th May 2013 (Annexure E). Consequently your petitioner got a notice for hearing of appeal filed u/s 19(1) of RTI Act 2005 [First Appeal] on 12th June 2013 (Annexure F). 8. That your petitioner received an order from FAA of Law Department under RTI Act 2005 through letter on 20th July, 2013 (Annexure G) stating that your petitioner should appeal before the FAA at the Office of Supdt. of Police, Santinagar as the case is closely related to the functioning of the SPIO to the office S.P., Santinagar. 9. That your petitioner filed his First Appeal to FAA at the Office of Supdt. of Police, Santinagar as per the order received from the FAA of Law Department on 2nd July, 2013 (Annexure H) but this appeal was refused by FAA at the Office of Supdt. of Police, Santinagar without any valid reason (Annexure I). GROUNDS I. Since investigation has been ended, final charge sheet has been given to the court and bail has been granted by the court, getting this information under RTI act 2005 cannot be rejected U/S 8(1)-(h) of RTI act 2005 and your petitioner has right to get the certified copy of final charge sheet and corresponding documentary evidences for the support of those charges under RTI act 2005. II. Your petitioner has also right to know the process of investigation that has been completed by the I.O. under RTI act 2005. This will help the prosecution also the same questions might be asked in the court also. If I don’t get this information then it violates my human rights also. III. If the court still feels that your petitioner’s understanding is wrong then please mention that by which section and/or sub-section of RTI act 2005 I don’t have right to get it with justification? IV. By which section and/or sub-section of RTI act 2005 the Deputy Superintend of Police (Industrial) did not answer your petitioner’s question with justification? If he did not have scope anyhow then why he did not fallow Section 6(3) of the RTI Act 2005 and send it to the concern authority knowing your petitioner by speed post with justification? V. The said public authorities did not follow Section 6(3) of RTI act 2005 properly while routing the application within 5 days from the date of receiving the Application. Your petitioner humbly prays before your lordship as follows: - A) Instruct the FAA and PIO to provide information to each point separately. No clubbing of points even if information may be repeated within 15 days. B) Instruct the FAA and PIO, in writing, to give complete information as requested in my above - mentioned R. T. I. Application. C) Instruct the FAA and PIO, in writing, to give complete information as requested in my above - mentioned R. T. I. Application. D) Now that the rest of the information will be provided after the mandated 30 days time period, and inspection will also be allowed after the 30 days are Over, the information and inspection should be allowed and it should be “free of charge” as per sec 7(6) of the RTI Act 2005. E) Issue a written warning to the PIO, under the present Rules and Regulations of Service, instructing him that he should adhere to the time limits specified in the RTI Act 2005/ pay little more attention to RTI application as well as respect the RTI Act in its letter and spirit. F) Imposition of penalty on appropriate FAA and PIO u/s 20(1) of the RTI Act, at the rate of Rs.250.00 for every day of delay (subject to a maximum of Rs. 25,000.00) from the date the information was due till the date the information is actually given to me. G) Recommendation for disciplinary action against FAA and PIO u/s 20(2) of the RTI Act. H) Recommendation for Compensation to be paid to me by Public Authority u/s 19(8.b) of the RTI Act. I) Cost. J) Any other relief that your honor might deem fit.
